Terms of Service
Last updated 2026-05-02. By using fairb.com or the Fairbuild platform, you agree to these terms.
Use the website normally and don't try to break it. The Fairbuild platform is governed by a separate Master Service Agreement signed at contract start; these terms cover only marketing-site use and pre-contract account creation.
1. Scope
These terms apply to the public website at fairb.com, the marketing materials it links to, and any pre-contract account or sandbox access. The Fairbuild settlement platform itself is governed by the Master Service Agreement (MSA) you sign as part of onboarding; that document supersedes these terms for platform use.
2. Acceptable use
Don't try to compromise the website, scrape it for AI training without permission, attempt to discover security vulnerabilities outside our coordinated disclosure process, send abusive content through forms, or impersonate other users. Coordinated security disclosures are welcome at security@fairb.com.
3. Intellectual property
The site, brand, copy, and original imagery are property of Fairbuild Inc. The settlement-contract code published at github.com/fairb-dev/Fairfoundry is open source under the license stated in the repository — those terms govern the contract code, not these terms.
4. No warranty for marketing materials
The website describes how the platform is intended to behave. Specific platform behavior is governed by the MSA, the deployed contract code, and the spec encoded for each manufacturing program. Where the website and the MSA disagree, the MSA controls.
5. Limitation of liability
Our liability for any claim arising from website use (excluding platform use, which is covered by the MSA) is limited to the greater of $100 or fees you have paid Fairbuild in the past 12 months. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow limitation of incidental or consequential damages — those provisions may not apply to you.
6. Governing law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Venue for any dispute arising under these terms is the state or federal courts located in Santa Clara County, California.
7. Changes
We may update these terms; the "Last updated" date at the top will reflect the change. Continued use of the website after a change constitutes acceptance. Material changes will also be announced on the home page or via email to customers with active accounts.
